Terms and Conditions
1. Booking Terms & Conditions: All services provided are subject to the terms and conditions of the respective service providers, including airlines, hotels, and tour operators. Please review their policies regarding cancellations, changes, and refunds.
2. Payment & Currency: All payments must be made in accordance with the payment terms outlined. Prices are subject to change based on availability and exchange rates at the time of booking.
3. Travel Insurance: We highly recommend purchasing travel insurance to cover unforeseen circumstances such as cancellations, medical emergencies, and lost baggage.
4. Liability: The travel company acts solely as an intermediary between the client and the service providers. We are not liable for any loss, injury, or damage arising out of the services provided by third parties.
5. Cancellations & Refunds: Clients are eligible for a full refund of service fees prior to booking confirmation. Once a booking has been confirmed with a third-party provider (e.g., lodging, transport), cancellation and refund terms are governed by that provider’s policies. SM Travel Co. will assist in facilitating the cancellation request, but we cannot guarantee refunds beyond what is provided by the service provider.
6. Force Majeure: We are not responsible for any changes, delays, or cancellations due to events beyond our control, including natural disasters, strikes, or government regulations.
7. Travel Documentation: It is the responsibility of the traveler to ensure that all required travel documents (passports, visas, etc.) are obtained and valid prior to travel.
8. Client Responsibility: Clients are responsible for ensuring that they meet all necessary health, safety, and entry requirements for their destination, including vaccinations or COVID-19 regulations.
9. Please Note: Flight prices are dynamic and may change at any time. Quotes are based on current availability and are not guaranteed until full payment is received and the booking is confirmed.
10. Service Fees & Non-Refundable Deposits
Certain planning or booking service fees may be non-refundable, even if the trip is canceled, unless otherwise stated in writing. These fees cover the time, expertise, and administrative costs involved in arranging your travel.
11. Pricing Errors & Omissions
In the event of a pricing or availability error (including system glitches or supplier mistakes), SM Travel Company reserves the right to correct the booking or provide an alternative option of equal or similar value.
12. Itinerary Changes
We reserve the right to adjust itineraries when required due to operational needs, safety concerns, weather, or service provider changes. Every effort will be made to provide alternatives of equal or greater value.
13. Special Requests
Requests such as room location, bed type, early check-in, or late check-out are subject to availability and not guaranteed unless explicitly confirmed in writing by the provider.
14. Limitation of Liability
Our liability is limited to the total amount paid to SM Travel Company by the client for the booking in question. We are not responsible for indirect, incidental, or consequential damages.
15. Fraud & Chargebacks
If a payment is reversed (e.g., via chargeback) after services have been booked, the client remains fully responsible for the outstanding balance, plus any associated fees or penalties.
16. Communication & Contact Info
Clients are required to provide accurate and up-to-date contact information and to monitor communications for important updates, especially regarding urgent travel changes.
17. Health & Fitness to Travel
It is the client’s responsibility to ensure they are medically and physically fit to travel. SM Travel Company is not liable for any issues arising from a traveler being unfit to complete their trip.
18. Governing Law & Jurisdiction
This agreement is governed by the laws of the Commonwealth of Virginia, and any disputes will be handled in its courts of jurisdiction.
19. Third-Party Providers & Cancellations
SM Travel Company operates as an intermediary with trusted travel partners and service providers. In the event that a partner cancels or alters a booking, we will make every reasonable effort to secure alternative arrangements or obtain applicable refunds on your behalf.
